Truphle is operated by TRUPHLE, INC. (hereinafter, “we”, “our ” or “us”). We respect your privacy and are committed to protecting your information. This privacy policy describes our practices regarding personal information collected to operate fieldtorks.com and the Truphle app that can be downloaded from app stores (collectively, the “Services”).

It is important that you read this privacy policy together with any other privacy notice or fair processing notice we may provide on specific occasions when we are collecting or processing information about you so that you are fully aware of how and why we are using your data.

Information Collection

We may collect the following types of information about you:

  • Identity Data, which includes name or other similar identifiers.
  • Contact Data, which includes address, email address and telephone numbers.
  • Financial Data, which includes credit card, debit card or other payment card details.
  • Transaction Data, which includes details about payments to and from you.

In cases where Truphle Inc. specifically states that some Data is not mandatory, Users are free not to communicate this Data without consequences to the availability or the functioning of the Service.

Any use of Cookies – or of other tracking tools – by Truphle Inc. or by the owners of third-party services used by Truphle Inc. serves the purpose of providing the Service required by the User, in addition to any other purposes described in the present document and in the Cookie Policy, if available. Users are responsible for any third-party Personal Data obtained, published or shared through Truphle Inc. and confirm that they have the third party’s consent to provide the Data to the Owner.

Using Our Services: As you interact with our Services, we may automatically collect Technical Data and Usage Data about your use of our Services. Some of the ways in which we may collect information are further described below:

  • Cookies and other technologies:The Services may use cookies, a type of technology that installs a small amount of information on a website user’s computer or other device to permit a website to, for example, recognize future visits using that computer or device. The Services may use other similar technologies (including, without limitation, tracking pixels, as described further below, and other anonymous identifiers) to gather information about you, such as IP addresses and location data, to customize your visit, to enable us to enhance our Services, or for other purposes. 
  • Interest-Based Advertising:We may engage third-party vendors to use your information in connection with their own information to deliver targeted advertising to you when you visit our website or other websites. Cookies, described above, may be used in this process. For example, if you are searching for information on a particular product, our vendor may cause an advertisement to appear on other websites you view with information on that product. This form of advertising is called “Behavioral Advertising.” We believe that such advertising is helpful because you will see ads that are relevant to your interests.   • Clickstream Data:When you use the internet, websites collect information about the type of computer and browsing software you use and the address of the website from which you linked to the website. The Services may collect and use clickstream data as a form of aggregate information to anonymously determine how much time visitors spend on each page of our website, how visitors navigate throughout the website and how we may tailor our website to better meet the needs of visitors. This information may be used to improve our Services. Any collection or use of clickstream data will be anonymous and aggregated and will not intentionally contain any information about you.
  • Location Data:When you give us consent, we will collect the latitude and longitude coordinates of your device when you are searching restaurant availability. We use this information to help us improve the relevance of search results and streamline the restaurant reservation processes. This information is only collected while the app is running. We also use general geographic data to identify the city a user is visiting to make the Services more relevant. Collection of personal information/personal data from third-party sources: We also collect personal information/personal data about you from various third parties and public sources.

  • If you register for our Services using Facebook, Twitter or other social media sites, we will import your information from those social media sites
  • When a new restaurant joins us, we will collect any information that restaurant has about prior guests and import it into the restaurant’s guestbook on our Services.
  • We also obtain information about you from restaurants who partner with us, including notes, tags, and other metadata about your dining habits and experiences.

Data Relating To Children

Our Services are intended for those 17 years old and older. We don’t intentionally gather data from anybody younger than 17 (or such other age as might be restricted under local law). If we are made aware that we have received such information, or any information in violation of our policy, we will use reasonable efforts to locate and remove that information from our records.

Data Retention

We will only retain your information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for your information, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of your information, the purposes for which we process your information and whether we can achieve those purposes through other means, and the applicable legal requirements.

In some circumstances we may anonymize information about you (so that it can no longer be associated with you) for research or statistical purposes in which case we may use and retain this information indefinitely without further notice to you. If your account is closed, we may take steps to delete certain information, but we reserve our ability to retain and access the data for so long as required to comply with applicable laws. We will continue to use and disclose information in accordance with this privacy policy.

Data Security

We will keep your information confidential and limit access to your information to those who specifically need it to conduct their business activities, except as otherwise permitted by applicable law. We refer to industry standards and use reasonable administrative, technical and physical security measures to protect your information from unauthorized access, destruction, use, modification or disclosure. We require industry standard data security measures from those third parties who are authorized by us to process your information on our behalf.

Place

The Data is processed at the Owner’s operating offices and in any other places where the parties involved in the processing are located. Depending on the User’s location, data transfers may involve transferring the User’s Data to a country other than their own. Users are also entitled to learn about the legal basis of Data transfers to a country outside the European Union or to any international organization governed by public international law or set up by two or more countries, such as the UN, and about the security measures taken by the Owner to safeguard their Data. Why We Collect Personal Information

Depending on your relationship with us, we may use information about you for our business purposes, including:

The Rights Of Users

Users may exercise certain rights regarding their Data processed by the Owner.

In particular, Users have the right to do the following:

  • Withdraw their consent at any time.Users have the right to withdraw consent where they have previously given their consent to the processing of their Personal Data.
  • Object to processing of their Data. Users have the right to object to the processing of their Data if the processing is carried out on a legal basis other than consent. Further details are provided in the dedicated section below.
  • Access their Data.Users have the right to learn if Data is being processed by the Owner, obtain disclosure regarding certain aspects of the processing and obtain a copy of the Data undergoing processing.

Details About The Right To Object To Processing

Where Personal Data is processed for a public interest, in the exercise of an official authority vested in the Owner or for the purposes of the legitimate interests pursued by the Owner, Users may object to such processing by providing a ground related to their particular situation to justify the objection.

Users must know that, however, should their Personal Data be processed for direct marketing purposes, they can object to that processing at any time without providing any justification. How To Exercise These Rights

Truphle Inc. uses Cookies. Cookies consist of portions of code installed in the browser that assist the Owner in providing the Service according to the purposes described. Some of the purposes for which Cookies are installed may also require the User’s consent.

Truphle Inc. uses Cookies to save the User’s session and to carry out other activities that are strictly necessary for the operation of Truphle Inc., for example in relation to the distribution of traffic.

Truphle Inc. uses Cookies to save browsing preferences and to optimize the User’s browsing experience.

Among these Cookies are, for example, those used for the setting of language and currency preferences or for the management of first party statistics employed directly by the Owner of the site.

Updates To This Privacy Policy

We reserve the right, at our discretion, to change, modify, add, or remove portions from this privacy policy at any time. However, if at any time in the future we plan to use your information in a way that materially differs from this privacy policy, we will post such changes here and email you. We encourage you to periodically review the privacy policy for the latest information on our privacy practices. You are bound by any changes to the privacy policy when you use the Services after such changes have been first posted
